All materials found on the www.beherbie.com website are the exclusive intellectual property of the company Herbie d.o.o. and may only be used with the express permission of the copyright holder. Herbie d.o.o. enables the use of the services and content of the www.beherbie.com website as regulated by these Terms of Purchase (Pre-contractual Information).

These Terms of Purchase (Pre-contractual Information) are part of the Seller's obligations in accordance with the provisions of the Consumer Protection Act and serve to ensure that the Buyer is clearly and understandably informed about a number of circumstances important for concluding, performing, and terminating the contract before concluding a distance contract, all in accordance with the legal regulations.

The term Buyer primarily refers to a classic consumer protected by the Consumer Protection Act, i.e., a natural person who orders and pays for any product outside of any business activity through the services of the web store present on the Seller's website, but also to buyers who are craftsmen, individual traders, and natural persons engaged in business activities, who are protected by the provisions of the Consumer Protection Act only if they purchase products unrelated to their business activities, and to all other buyers.

The Seller sells through the website www.beherbie.com acts on their own behalf.

Terms of Purchase (Pre-contractual Information) are part of the distance contract together with the specifications and price(s) of the purchased product(s), and before confirming the order for the purchase of a particular product, the Buyer will be asked to accept/declare that they are familiar with/agree to them, while after confirming the order (concluding the contract) the Buyer will receive an email with an order confirmation confirming that the contract has been concluded. The Seller reserves the right to change the terms at any time, with such changes taking effect after being published on this website.

When the Buyer confirms and places an order, the contract is concluded, and the Seller will immediately notify by email that the order has been received, which thereby means that the contract has been concluded.

For a valid contract to be concluded, the Buyer must be a person with full legal capacity.

The Buyer is responsible for the completeness and accuracy of the data entered during registration.

Purchase conditions (Pre-contractual information) are divided into the categories/information listed below.

Access to the website www.beherbie.com may sometimes be unavailable due to works, maintenance, or the introduction of new content, as well as in cases of unforeseen circumstances beyond the Seller's control, which the Seller will strive to resolve as soon as possible.

Main product features

Herbie j.d.o.o. offers flowers and pollen (THC <0.2%) of industrial hemp in the form of a fragrant substance. The products are not intended for consumption. Furthermore, the products must not be further processed if the product resulting from processing is not in accordance with the relevant national legislation. The quantity of the product is stated in grams.

The Seller also offers fragrant herbal blends whose composition is 100% natural. They do not contain THC or other cannabinoids or synthetic additives. They are not intended for consumption but exclusively for external use as potpourri (fragrant herbal blends). The quantity of the product is stated in grams.

Herbie d.o.o. explicitly emphasizes that our products found on www.beherbie.com or other sales locations are not intended for consumption by smoking or any other method involving combustion.

Products are displayed descriptively and with photos. Photos showing a bulk product, i.e., where multiple identical products appear in the photo, the price refers to one individual product, unless otherwise stated.

Product photos are illustrative in nature and may not always correspond in all details to the products that are the subject of the order. The Seller particularly emphasizes that the visual identity of the product shown in the photo may not match the actual appearance of the product, especially considering the settings of the buyer's computer monitor, differences in color perception as seen by the Buyer on the screen, and the like. In the case of the above-mentioned discrepancy between the product shown in the photo and the delivered product, this does not constitute a product defect.

Product data (product description, price, etc.) displayed on the website www.beherbie.com are subject to bugs, i.e., irregularities in the application operation, other technical irregularities, typographical errors, and the like. In case of obvious errors or inaccuracies regarding product data displayed on www.beherbie.com the Seller reserves the right to unilaterally terminate the contract.

Only products marked as available and accessible in the order can be the subject of the order. Due to the large number of orders placed simultaneously on www.beherbie.com, it may happen that the information about product availability does not match the stock status.

If the ordered product is not available in stock, the Seller will notify the Customer that the product is currently unavailable, the time frame in which the product can be supplied, and simultaneously offer the possibility to purchase an alternative product from www.beherbie.com that is available for delivery and is closest in characteristics to the product that cannot be delivered.

Prohibition of further processing

Products purchased from the seller may only be further processed if it complies with all legal provisions.

Product price

Prices displayed on the website www.beherbie.com are expressed in euros. Delivery costs are not included in product prices because they are paid separately, all in accordance with the terms and in the manner indicated by these Purchase Terms (Pre-contractual information).

Before confirming the order, the product price, delivery price if chargeable, and the final price are separately stated so that the Customer has insight into the final price paid for the ordered purchase service.

In case of payment by e-banking and general payment slip, payment and/or interbank transaction fees are not included in the price.

Late payment

In case of late payment, the seller has the right to charge statutory default interest at a rate of 4% above the base rate. If the buyer acts within their business activity, the default interest amounts to 9.2% above the base rate.

In addition to charging statutory interest, the seller is also entitled to compensation for damages caused by the buyer's fault, especially necessary costs incurred due to appropriate out-of-court debt collection, provided that the costs are proportional to the claims.

In case of late payment, our company has the right to charge compound interest from the date of product delivery. Unless otherwise agreed, this interest amounts to 4% per annum.

Delivery costs

The delivery price within Croatia is €4.50 for delivery by GLS courier service with a fee of €1.50 for cash on delivery payment. For delivery within Europe (except the UK), delivery costs €7.00, delivery for the UK €10.00 and the rest of the world from €10.00 to €20.00. VAT is included in the price.

In case of failure to properly deliver to the Customer's address indicated by the Customer, the Customer bears the costs of redelivery to the same or another address depending on the information the Customer provides to the Seller during the delivery verification of the order.

Terms and deadlines of payment, conditions of goods delivery, delivery time of goods

Products are ordered by selection, using the menu, and filling out an electronic form. The buyer can order and purchase a product as a registered or unregistered user. The product is considered ordered when the buyer completes the entire ordering process.

Payment for ordered products can be made in the following ways:

- Cash on delivery (payment upon product delivery)
- Prior payment to a bank account (general payment slip/bank transaction)
- Card payment (Corvus Pay)

 

When shopping at www.beherbie.com, it is necessary to choose a payment method – cash on delivery, Corvus Pay, or prior payment to a bank account.

If the buyer does not receive notification that the contract has been concluded after completing the ordering process, it is suggested to check:

- Is the message in the Junk/Spam folder

- Is the mailbox full

If the payment is not made within the specified period, the Seller will proceed with delivery of the purchased products upon late payment, and if delivery cannot be made for justified reasons, the contract will be unilaterally terminated and the paid funds refunded.

If the payment is properly made and visible in the Seller's account, the Seller will proceed with the delivery of the ordered products. The invoice for the order is sent by email and included in the shipment with the goods.

Retention of title

All contracts between the buyer and the seller are concluded with retention of title. The delivered product remains the property of the seller until the buyer fully settles the purchase price. If the buyer receives the product despite non-payment, they bear the risk of depreciation or loss of the product until the invoice is settled.

Warranty and guarantee

Products displayed in the online store are subject to statutory warranty. Furthermore, product descriptions in catalogs or in the online store do not carry any additional warranty or guarantee.

Change of buyer's address

The buyer is obliged to notify the seller of any change of their residential or business address if both parties have not fulfilled their contractual obligations. If such notification is omitted, all claims sent to the last known address will be considered valid.

Plans, sketches, or other technical documents remain as samples, catalogs, brochures, illustrations, and the like as the intellectual property of the seller; the buyer has no right to use or exploit them.
